In September 2023, truck driver Jason Killinger was wrongfully arrested at
the Peppermill Casino in Reno after facial recognition software incorrectly identified him as Michael Ellis, a man previously banned from the property.

The key details of the incident and the resulting legal action are as
    follows:

The Incident: Despite providing valid identification, Killinger was accused
by Reno Police Officer Richard Jager of using a fraudulent ID. He was
detained for 11 hours and held in handcuffs for four, resulting in physical injuries.

Police Misconduct: The lawsuit alleges that Officer Jager ignored evidence of Killinger's true identity-even after a fingerprint check at the jail
confirmed it-and filed a police report claiming Killinger had provided conflicting identities.

Lawsuit Expansion: A federal judge recently allowed the City of Reno to be added as a defendant. The lawsuit claims the city continued legal pursuits against Killinger even after he was exonerated and failed to train officers
on the limitations of facial recognition technology.

Systemic Allegations: Killinger's lawyers argue that this was not an isolated incident but part of a widespread "custom and practice" within the Reno
Police Department. They claim the department has made "thousands" of similar arrests despite knowing that facial recognition results are unreliable for probable cause.

Legal Claims: Killinger is seeking compensatory and punitive damages for violations of his Fourteenth Amendment due process rights and the fabrication of evidence through the concealment of exonerating facts.

Previous Settlement: Killinger has already reached an out-of-court settlement with the Peppermill Casino for an undisclosed amount.
